BAR BRAWL VIDEO COULD BE EVIDENCE

There could be an interesting legal angle in a high-profile Clark County case.36-year-old Tyler Meier is charged with Felony Murder ? Battery after he punched 43-year-old Keith Young at the Brickyard Bar and Grill on February 1st. Young fell to the floor, apparently hitting his head. He died of blunt force trauma to the head.
Clark County District Attorney Darwin Zwieg has filed a memo stating he plans to use surveillance video shot at the bar as evidence under the ?silent witness theory.?
Typically, photos and video can be offered only as ?demonstrative evidence? backed by eye-witness testimony.
However, Zwieg says the surveillance video was shot from a different perspective; therefore, no witnesses saw the things it captured.
Meier?s attorney, Harry Hertel, says he?ll not object to the use of the video during the preliminary hearing, which is scheduled for May 12. He says that hearing will likely focus on the cause of Young?s death, not the events that proceeded it.
However, he hints the use of the footage will likely be challenged prior to an actual trial.
Meier remains free on a cash bond.
