DNR Can Continue to Test for PFAs Contamination, But Can't Enforce Any Action

Thursday, January 27th, 2022 -- 8:00 AM

(Bob Hague, WRN) -The state Department of Natural Resources may continue to sample for PFAs contamination, but a judge has ruled out enforcement action.

The Journal Sentinel reports a 45-page decision was issued by Jefferson County Judge William Hue this week. Hue found that under the Clean Water Act, the DNR can continue to sample for PFAS for informational purposes, but cannot take any enforcement action until the Legislature establishes water quality standards for the so-called “forever chemicals.”

PFAS compounds have been confirmed in locations around the state, from Milwaukee and Madison to Eau Claire, La Crosse, Rhinelander and Marinette.
