Supreme Court Taking Up Another Challenge to the Affordable Care Act

(WRN) -The US Supreme Court is set to take up yet another challenge on the Affordable Care Act and left wing groups are keeping an eye on the case.

As the US Supreme Court again decides to take up a challenge to the Affordable Care Act, a Wisconsin progressive group is calling foul. Robert Kraig of Citizen Action of Wisconsin says this is yet another endaround on getting rid of Obamacare.

"It is amazing how no matter how many times they lose, conservatives politicians and judges keep trying to repeal a really common sense health care law."

Kraig says conservatives are hinging their case on the removal of the law that requires people have insurance or pay a fine.

"So they're invalidating that invalidates the whole law, because one of the Justices that upheld it before, Chief Justice Roberts, actually upheld the law on the basis of the taxing power in the Constitution."

Kraig says Republicans are pinning their legal case on the fact that Congress removed the individual mandate from the law, which was the basis for it being upheld the last time it was in court.

"So their argument is that the whole thing should be thrown out because of that. Most legal experts didn't believe that was a very strong argument, but right wing judges at the district court level and the appeals court level have sided with the state of Texas, which is the lead plaintiff."

Oral arguments for the case are set for this fall. Wisconsin was part of this lawsuit, before Governor Evers and Attorney General Josh Kaul pulled out of the suit last year.
