Spencer Woman Now Found Competent in Sexual Assault Case

-A Spencer woman facing charges for sexually assaulting a 15-year-old boy multiple times was found competent for her court proceedings to continue on Thursday.

According to court records, Linda Habhegger, said she would watch the boy from time to time and even considered herself a mother or aunt figure to the boy. Habhegger, who said she was sexually abused as a child, admitted to authorities she had sex with the boy multiple times at her home between July and September. She said she told the boy he wouldn’t get into trouble. She also told authorities that she didn’t think she did anything wrong. Habhegger had been charged with three counts of second degree sexual assault of a child. Last year, her competency was brought up by her lawyer. During a competency hearing in August of last year, the judge found Habhegger was not competent for the court proceedings to continue.

However, the judge felt that Habhegger could become competent within a year with proper treatment and counseling. The judge initially set a hearing date for August 24th of 2020, with progress filed 9 months, 6 months, 3 months and 1 month before the hearing. During a hearing held yesterday, the judge felt Habhegger was competent to proceed. A future court date of March 31st was set. If she’s convicted and sentenced to the maximum amount, she could face up to 120 years in prison.
