Colby Man Charged with Sending Sexually Explicit Material to an Underage Girl Appears in Clark County Court

-A Colby man charged for sending sexually explicit material to an underage girl appeared in Clark County Court on Wednesday.

According to court records, the mother of a 17-year-old girl from Spencer reported to the Spencer Police Department that she believed 27-year-old David Paul, of Colby, was sending her daughter explicit material through Facebook. An investigation by the department uncovered a series of sexually explicit messages between Paul and the girl starting back in February. In one of those messages, it was made clear that Paul knew the girl was underage and still in high school. Throughout the beginning of the year, Paul sent a number of multiple lewd photos and at least one video of himself to the girl. The girl’s mother had stated that Paul and her daughter had only crossed paths once at the Colby High School before he began sending her messages. Paul was working as a custodian there at the time. They never met after the messages began. Paul was suspended form the district back in May and then fired on June 17th after the district reviewed the investigation by the Spencer Police Department.

Paul is facing a charge of causing a child, age 13-18, to view sexual activity. During his preliminary hearing on Wednesday, probable cause was found so his court proceedings will continue. He also entered a not guilty plea to the charge against him. He has a $3,000 signature bond was set and he’s not allowed to have any contract with the victim. He’s also not allowed to use internet capable devices. If convicted and sentenced to the maximum amount, he could face six years in prison.
