No Charges Filed in September Stand Off Shooting

No charges will be filed against the Marathon County officer involved in a fatal Clark County shooting last month.

Deputy Russell Gage fatally shot Robert Domine after an hours long standoff at Domine’s Loyal residence that ended September 13th.

Nearly two days worth of incidents ended when Gage fatally wounded Domine, after the 77-year-old fired upon officers as they tried forcing him from the residence.

Domine resisted arrest on September 11th in Loyal, after police attempted a traffic stop for an outstanding Taylor County warrant. Domine fled the city, and his in some nearby woods overnight, before returning to his home the next day. Domine holed himself up inside that residence until the next morning. He fired two shots through a rear door at officials who attempted to enter, with one round striking a Clark County Sheriff’s Deputy in his bullet-proof vest. That’s when the Marathon County SWAT team used an armored vehicle to damage the front window and enter the residence. Domine fired at least three shots, and Gage then returned fire, fatally wounding Domine at the scene.

According to a press release from the Clark County District Attorney’s Office, the actions of Deputy Gage were a reasonable act of self-defense.
