Black River Falls Man Accused of Hitting a Pedestrian Appears in Jackson County Court

-A Black River Falls man accused of drunk driving and hitting a Merillan man appeared in Jackson County Court on Monday.

According to the Jackson County Sheriff's Department, the accident happened around 9pm on U.S. Highway 12/27 near the westbound ramp of I-94. The department said that Dean Brown was walking home from work when he was struck by Joseph Cholka of Black River Falls. Brown had injuries to his face, mouth and leg.

Cholka was arrested and charged for his 5th OWI. He was also charged with bail jumping and operating after revocation among other charges. He appeared in court for a competency hearing on Monday. An evaluation by Lutheran Social Services determined that Cholka was incompetent, but he could regain his competency. The state didn't contest the findings and Cholka will be back in court in November.
