Clark County's Truck Saga Continues...

-Clark County's truck saga between the Law Enforcement Committee and Sheriff's Department will continue.

During a Law Enforcement Committee Meeting on Thursday afternoon, the LEC discussed, in closed session with Corporation Counsel Jacob Brunette, their strategy regarding Clark County Sheriff Greg Herrick's case against them regarding the purchase of a truck for the department. The committee initially approved the purchase of the truck under protest, but passed a motion at another LEC meeting denying the sheriff from taking possession of it. The sheriff purchased the truck and several other vehicles without the committee's approval.

The committee discussed the case for over an hour. When they returned to open session the committee passed a motion reading: "To hold the county truck purchase by the Clark County Sheriff's Department and not put such truck in use in any kind and such truck shall remain as is pending further action by the Clark County Board of Supervisors." Each member of the committee approved the motion.

So, as of now, it would seem that the court proceedings will continue. At an injunction hearing held on April 1st, Portage County Judge Eagon Thomas denied the Clark County Sheriff's injunction, which would have allowed him to take possession of the truck, against the committee stating it doesn't meet legal requirements. However, he also said that he felt this committee and the county board was exceeding its authority and had no right keeping the sheriff from taking possession of the vehicle. He said the sheriff should have the right to take it as the county has already purchased it and they have to pay for it either way. He also felt the case was trivial and hoped that both parties could reach an agreement before the next court date, a telephonic scheduling conference, on July 22nd.
