Loyal Man Sentenced for Hitting Greenwood Ambulance

Wednesday, December 17th, 2014 -- 12:53 PM

-A Loyal man was sentenced in Clark County Court on Wednesday for hitting a Greenwood Ambulance last year.

At the beginning of June of 2013, Kevin Colby, along with his passenger Angela Colby of Loyal, drove through the intersection of H and 73 striking the Greenwood ambulance as it was returning from a call. It was later determined that Colby had a blood alcohol level of .184, well above the legal limit. He also told authorities that he thought he was on a completely different road.

Colby was originally scheduled for a jury trial today and tomorrow, but in the end a plea agreement was reached between the state and defense. Colby agreed to enter a plea to count 1 and 3 of the 4 counts against him which were causing injury while under the influence. Counts 2 and 4, also causing injury while under the influence were dismissed and read in. Colby was found guilty of, due to a no contest plea, counts 1 and 2.

The state asked for 2 years' probation and 90 days in jail, $300 for each of the two counts plus costs, revoking his license for 18 months, installing an ignition interlock device for 18 months and providing over $3,000 in restitution to the victims in the incident. The defense agreed to everything, but asked for 1 year of probation.

In the end, the Judge agreed to everything the state asked for, with the stipulation that if Colby's probation officer feels it's appropriate, Colby may be released from probation after 1 year.
