No Additional Jail Time for Marshfield Man Regarding the Death of his Girlfriend

Tuesday, October 22nd, 2013 -- 8:21 AM

-A Marshfield man accused of beating his girlfriend to death was sentenced for the crime a second time on Monday during a hearing in Marathon County Court.

In 2009, Eric Mayer, age 32, was charged with the death of his girlfriend Cynthia Tyler. Mayer told investigators that he hit her in the face after she had kicked him in the mouth. When Mayer hit her, Tyler was knocked unconscious and she later died of a ruptured artery in her brain.

In March of 2010, a plea deal was reached and Mayer pleaded no contest to felony murder. He was sentenced to 10 years in prison.

Mayer recently appealed the conviction saying he had ineffective counsel. Mayer?s attorney had been undergoing treatment for cancer at the time and has since died. Mayer was granted a trial that was supposed to begin Monday before a deal was reached. The deal was reached as some medical evidence had gone missing.

Under this new deal, Mayer will not spend the full 10 years in prison that he was initially sentenced to, but a judge did sentence him to 19 months in prison on Monday. However, he has already served that time so he will spend no more time in prison, but he will be on six years supervision.
