Stanley Prison Inmates' Appeal Fails

-Two Stanley Prison inmates? attempt to have their case involving an attempted escape appealed has failed.

In January of 2010, Eddie Evans, age 59, Jimmy Baldwin, age 34, and Henry Spencer, age 27, had release documents forged to get early releases. Evans and Baldwin did escape, but were caught a few days later. Spencer was caught before he was released.

Spencer was already found guilty and sentenced for his part in the crime. He had an extra year and half added onto the sentence he?s serving for armed robbery.

A four day trial for Evans and Baldwin was supposed to start in mid-March, but Evans filed a Notice to the Appeals Court and all further court proceedings were stayed until the appeals were completed.

Evans and Baldwin were hoping the case would be dismissed as they claimed evidence was acquired illegally and their rights were violated.

It was deiced by the Appeals Court to dismiss the appeal which had asked the courts to dismiss the case without prejudice. The court proceedings will continue, but no future court dates have been decided.
